Forming a Legal Domestic Partnership

California law defines domestic partners as two adults who have chosen to share one another's lives in an intimate and committed relationship of mutual caring. A domestic partnership is established in California when both persons file a declaration of domestic partnership with the California Secretary of State showing that all the following requirements are met:

  • Both persons have a common residence
  • Neither person is married to someone else or is a member of another domestic partnership with another person
  • The two people are not related by blood in a way that would prevent them from being married to each other in the State of California
  • Both people are at least 28 years of age
  • One or more of the following stipulations may also apply:

a. Both people are members of the same sex
b. One or both persons are over the age of 62, regardless of sex
c. Both people are capable of consenting to the domestic partnership

Dissolving a Domestic Partnership

Dissolving a legal domestic partnership is much the same process as dissolving a marriage through divorce. The courts will consider all assets and property acquired over the length of the formal partnership to be community property and subject to equal division between the parties. In the event a child custody issue arises, the courts must consider child custody and child support issues and parenting time.
