Premarital/Postnuptial

Protect Your Personal Assets In Case the Worst Happens

California is a community property state. That means that all assets in a marriage are considered to belong in equal share to both partners in a marriage or domestic partnership. Even personal assets brought into the marriage by either or both parties may be subject to equal division in a divorce settlement, unless a prenuptial or postnuptial agreement protects individual assets.

"I have been a California family law attorney for more than 27 years. I have seen prenuptial agreements protect the financial futures of many people who ended up in divorce. I have also seen them declared invalid because they were not drafted according to specific requirements. Let me help you get your prenup done right." Attorney Victor Castro

If you are considering entering into marriage or a legal domestic partnership in California, make sure you understand how important a prenuptial agreement can be. Contact the Law Office of Victor M. Castro to discuss your circumstances. Our firm offers a free initial telephone consultation.

What Will a Proper Prenuptial Agreement Include?

A premarital agreement is a legal contract between prospective spouses or domestic partners. A premarital agreement is in writing and signed by both parties. When properly executed, it is enforceable without consideration. After marriage, a premarital agreement may be amended or revoked only by a written agreement signed by the parties. The amended agreement or the revocation is enforceable without consideration.

To be airtight, a prenuptial or postnuptial agreement must be executed well in advance of the marriage date. The terms of the agreement cannot overwhelmingly favor one party's financial interests. It is best that both parties have their own legal representation.

Our law office offers the knowledge, skill and experience to identify all of the issues in your particular case. Victor Castro will advise you of the issues involved in a proper prenuptial agreement or postnuptial modification and what legal position protects your interests best. Our firm has represented hundreds of clients in all matters relating to premarital and postnuptial agreements and property settlements.
